Chat Mobility is committed to protecting your privacy in order to give you the best possible mobile wireless (CMRS) and/or wireless data experience. Our Privacy Policy is to protect your Customer Proprietary Network Information referred to throughout this document as C.P.N.I. This covers Chat Mobility as it applies to information we obtain when subscribers order or use mobile wireless (CMRS) and/or wireless data services.
C.P.N.I.
Privacy concerns center on information that can be associated with a particular individual or entity and includes a customer's name, address, telephone number, social security number, e-mail address, etc…
Disclosure
Chat Mobility will not sell C.P.N.I. to any third party(s) obtained from the registration for or use of a Chat Mobility online service. We will not disclose any C.P.N.I. without the consent of the customer except: (i) as required by subpoena or other legal process; (ii) in the case of imminent physical harm to the customer or others; (iii) to protect Chat Mobility property. Chat Mobility agents, contractors and/or other companies who perform services on our behalf or in cooperation to the consistency of this Policy are required to protect our customer’s C.P.N.I.
Use of C.P.N.I.
Chat Mobility will collect and use C.P.N.I. for billing purposes to better meet your needs, resolve service problems, or to identify, create and inform you of products and services.
E-mail, text and instant messaging
Chat Mobility will not read your outgoing or incoming e-mail and text messages, private chat, or instant messages. Chat Mobility may store e-mail messages and text messages for a brief time. We may be compelled to disclose messages in order to comply with a court order, subpoena, or disclose information to protect an individual's safety. We may use C.P.N.I. to investigate and prevent potentially unlawful activity and action that threatens the network or otherwise violates the customer service agreement.
Security
Chat Mobility has security measures and policy guidelines to protect your C.P.N.I. from unauthorized access.
Children
Chat Mobility will not target children or teenagers for C.P.N.I. We encourage parents/guardians to spend time online with their children and participate in internet activity. All minors should have parental consent before using the internet or disclosing any C.P.N.I. online.
Updating Privacy Policy
When privacy policy updates occur, Chat Mobility will post them on our website at www.chatmobility.com.

Acceptable Use Policy
The Acceptable Use Policy below defines the actions that Chat Mobility considers to be abusive or unauthorized, and thus, strictly prohibited. The examples named in this list are nonexclusive and are provided solely for guidance to Customers and other persons using Customer accounts (collectively, "Users").
If you are unsure whether any contemplated use or action is permitted, please send e-mail to customerservice@Chat Mobility.com and we will assist you.
Please note that the actions listed below are also not permitted for the purpose of advertising any service hosted by Chat Mobility or connected via Chat Mobility networks. Services hosted by Chat Mobility or connected via Chat Mobility networks may not be advertised via deceptive marketing policies as defined by the Federal Trade Commission.
General Conduct
1. Users are prohibited from transmitting on or through any Chat Mobility services or networks any material that is, in the sole discretion of Chat Mobility, determined to be unlawful, obscene, threatening, abusive, libelous, or hateful, or deemed to encourage, aid or promote conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law.
2. Chat Mobility services and networks may only be used for lawful purposes. Uses or activities that violate any local, state, national or international law are strictly prohibited. Any unlawful use or activity is grounds for immediate termination and may subject the User to civil or criminal liability.
3. Customer is responsible for keeping all billing data with Chat Mobility up-to-date and accurate. Furnishing false data on the signup form, contract or customer application is grounds for immediate termination and may subject the Customer to civil or criminal liability.
4. The resale of Chat Mobility products and services is not permitted, except as specifically agreed by Chat Mobility and documented in an independent written agreement.
Copyright Infringement
1. Users may not use Chat Mobility services or networks to transmit any material (by E-mail, uploading, downloading, posting or otherwise) that infringes on any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
2. Notice of copyright infringement should be immediately sent to: General Manager, Chat Mobility, P. O. Box 289, Emerson, Iowa 51533.
System and Network Security
1. Users may not attempt to circumvent user authentication or security of any host, network or account ("cracking"). This includes, but is not limited to, accessing data not intended for the User, logging into a server or account the User is not expressly authorized to access, or probing the security of other networks by running a SATAN scan or similar tool.
2. Users may not attempt to interfere with service to any user, host or network ("denial of service attacks"). This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service and attempts to "crash" a host.
3. Users may not use any kind of program/script/command, or send messages of any kind, designed to interfere with another user's terminal session, via any means, locally or via the Internet.
4. Users who violate systems or network security may incur criminal or civil liability. Chat Mobility will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.
5. Activities that violate local, state, national or international law are strictly prohibited.
Domain Names
Chat Mobility may provide domain name service for Dedicated Connection Accounts. Keeping registry information updated and accurate is the responsibility of the domain holder and not the Chat Mobility.
1. Customers shall not falsify or omit valid domain contact information, including the administrative, technical, zone, and billing contacts.
2. Activities that violate local, state, national or international law are strictly prohibited.
E-mail
1. Harassment, whether through language, frequency or size of messages, is prohibited.
2. Users may not send E-mail to any person who does not wish to receive it. If a recipient asks to stop receiving E-mail from User, User must not send that person any further E-mail.
3. Users are explicitly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes but is not limited to bulk-mailing of commercial advertising, informational announcements and political content. Such material may only be sent to those who have explicitly requested it.
4. Users may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.
5. Malicious E-mail, including, but not limited to, "mailbombing" (flooding a user or site with very large or numerous pieces of E-mail) is prohibited.
6. Forging of header information is not permitted.
7. Chat Mobility accounts or services may not be used to collect replies to messages sent from another Internet Service Provider where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of the other Internet Service Provider.
8. These rules apply to other types of Internet-based distribution mediums, including any systems for sending FAX-like documents over the Internet. USENET postings are governed by the rules provided below.
9. Activities that violate local, state, national or international law are strictly prohibited.
USENET
1. Chat Mobility provides an uncensored news feed. As such, Chat Mobility does not control the content of the newsgroups available to Users. Chat Mobility is not responsible for the content of any USENET posting, whether or not the posting was made by a Customer or User.
2. Postings to USENET newsgroups must comply with the written charters or FAQs (Frequently Asked Questions) for those newsgroups. Advertisements should only be posted in those newsgroups whose charters/FAQs explicitly permit them. The poster is responsible for determining the etiquette of a given newsgroup, prior to posting to it.
3. Users are prohibited from posting the same or similar message to large numbers of newsgroups (excessive cross-posting or multiple-posting, also known as "USENET spam").
4. Users are prohibited from posting chain letters of any type.
5. Users are prohibited from posting binary files to newsgroups not specifically named for that purpose.
6. Users are prohibited from canceling or superseding posts other than their own, with the exception of official newsgroup moderators performing their duties.
7. Users are prohibited from forging header information. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.
8. Activities that violate local, state, national or international law are strictly prohibited.
IRC (Internet Relay Chat)
1. Chat Mobility is not liable for the content of any communications made on IRC.
2. IRC robots ("bots" or "clones") may not be run from Chat Mobility shell accounts.
3. Users may not attempt to impersonate others or use IRC anonymously by disguising their hostname or username.
4. Users are prohibited from using IRC scripts or programs that interfere with or deny service to other users on any server or host. Users are also prohibited from engaging in activities which harass other parties. This includes, but is not limited to, "flooding" (rapidly entering text with the intent to fill the screens of others), "flashing" (disrupting terminal emulation), "takeovers" (forcibly seizing operator privileges), attempting to send private messages to those who do not wish to see them (via "ignore"), attempting to return to a channel after being banned from it, and other disruptive behaviors.
5. Activities that violate local, state, national or international law are strictly prohibited.
IMPORTANT NOTICE REGARDING USE
OF INTERACTION DATA:
Interaction Data
Your wireless device is equipped to provide interactive data services,
including BREW Express services available via the BREW Express services
catalog. You interact with the BREW delivery system (including BREW
application download software and BREW management center software) every
time you download or purchase a BREW-related product, application or
service from the BREW Express catalog. Your interactions with the BREW
Express delivery system create "interaction data" including
but not limited to:
- the metadata of the BREW applications and/or content distributed
to you (e.g., name, type, category, genre, file size, developer, date
created and/or distributed, etc.);
- the types of transactions you enter into (e.g., download, subscription,
pre-load, demonstration, etc.);
- your browsing activity within the BREW Express services catalog (e.g.,
categories viewed, BREW applications viewed, time spent, etc.); and
- information regarding your wireless devices.
How Your Interaction Data is Used
As an enhancement to BREW services, your interaction data may now be collected
and used to create recommendations for BREW applications and content that
may be of specific interest or value to you. Recommendations may be used
to market, promote and/or recommend BREW applications and content targeted
to your interests. These recommendations will be displayed in the BREW
Express catalog titled, “Recommendations”.
Any personally identifiable interaction data collected by the BREW delivery
system will be used solely for the purposes of providing recommendations
to you. Interaction data in aggregate or anonymous form may be used by
BREW for marketing, analysis, testing, research and development, business
development and to assist in the creation of recommendations for other
BREW customers. All information will be used only in accordance with applicable
laws, rules and regulations relating to privacy and consumer rights.
Opting Out
Targeted recommendations are provided as an enhancement to BREW Express
services in order to provide value and convenience to you. In all cases,
your interaction data will be handled responsibly, sensitively and in
compliance with applicable laws and regulations. If you prefer not to
receive targeted recommendations for any reason, you may opt out at any
time by clicking here.
If you opt-out of recommendations, your interaction data will continue
to be collected and used on an aggregated basis as part of the recommendations
created and displayed to other BREW users, though you will no longer receive
recommendations.
